Holland Conservation Commission

Minutes of Commission meeting held on July 25, 2006.
~
Present:  Mary vandenBerg, Chairperson, Steven Anderstrom, Patricia Caron, Howard Fife, Ann Hall and Rolf Hilbig.  Absent:  James Wettlaufer.

7:00 p.m.  Chairperson called the meeting to order.

7:05 p.m.  Minutes of Commission Meeting held on July 18, 2006 were read, accepted and will be
distributed.

Steven Anderstrom reports having observed mowing of grass right to the Stevens Brook at 241 Stafford Rd. by Kevin P. Roche who had come to the Conservation on July 19, 2005 where they had agreed that no cutting would be done within 25 ft. of Stevens Brook.  Motion made to write a letter requesting Kevin and Anita L. Roche to come to the Conservation Commission.  Seconded and approved by all.

7:35 p.m.  Tom Baltazar, Steve Bressette of Jalbert Engineering and Andre Cormier, Jr. of Escape Estates explained the project at 12 Sandy Beach Rd. to install a septic system.  A neighbor, John Brier also plans to install a septic system adjacent to the Baltazar property.  Both parties plan to share the cost of the storm water management controls on Sandy Beach as depicted on the map submitted by Andre Cormier, Jr.  An Agreement of Conditions will be written by Andre Cormier, Jr. and presented next Tuesday at 7:30 p.m.  Procedure Sheet not signed at this time.

8:00 p.m.  Bruce Neff and Elena Thompson of Brandon St. spoke of their concerns of sand filling in the cove.  They were informed that Escape Estates has plans to install a retention basin on Mashapaug Rd. between Fenton and Brandon Sts., which will help.

8:15 p.m.  The Public Hearing of the Andrew Harhay’s project on Mashapaug Rd., Lot 5, John Madeiros of Madeiros Consulting LLC presented DEP File #184-0205.  No abutters were present since they were not properly notified.  Following discussions, Mr. Madeiros asked for and received a copy of the Holland Conservation By-laws.  Motion was made to continue the hearing due to insufficient information and the abutters need to be notified.

8:45 p.m.  The Public Hearing of John Popolizio’s project at Alexander Rd., DEP File #184-0206 was presented by Michael Loin of Bertin Engineering.  Abutters present were: Ray Korny, Elaine and Anthony Lengowski and Ralph Verrier.  The Notice of Intent was in response to an Enforcement Order sent on May 16, 2006 where during the performance of perc testing, activities were not kept to a minimum and failure to file with NHESP (National Heritage and Endangered Species Program) for projects or activities within priority habitat of rare species.  Mr. Loin reports having received from the NHESP a letter sent to Wetland Specialist, David Teachout of Bertin Engineering stating “the MESA filing that has been submitted is incomplete in that it does not disclose the full extent of proposed development at the site.”  The submitted fee of $300.00 to NHESP was returned to Bertin Engineering.  The HCC also pointed out that their present plot plan does not show Lots 5 and 6 or the Certified Vernal Pools.  Mr. Loin said he would file a Notice of Intent for each of the 9 lots within the coming month.  In an effort to minimize the impact of the percolation testing within the buffer zone, he proposes to install siltation fences between the disturbed areas and BVW and to seed all disturbed areas with a fast growing rye seed.  All participants were in favor of closing the hearing at 9:20 p.m.



9:25 p.m.  Procedure Sheet #2006-1104 issued to Craig Road Realty Trust Richard Asselin, Trustee of 15 Craig Rd., Map R21-C-02 to repair a retaining wall lakeside.  He wanted to use pressure treated wood.  He was informed that it was illegal.  Riprap rock was recommended.  Motion to accept project was made and approved by all.  Procedure Sheet signed by Mary vandenBerg.

9:50 p.m. Procedure Sheet #2006-1105 issued to Yvette Lavigne of 107 Sandy Beach Rd., Map R-39-F-12 to remove existing 13’ x 9’6” deck and replace same.  Motion to accept project was made and approved by all.  Procedure Sheet signed by Mary vandenBerg.

Motion to adjourn made by Ann Hall, seconded and approved by all. Meeting adjourned at 10:00 p.m.
